Terms of Service

1. Acceptance of Terms

By accessing or using fShare ("the Service") at fshare.aquilainnovations.in, you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree to these Terms, do not use the Service.

These Terms constitute a legally binding agreement between you and Aquila Innovations ("Company", "we", "us", "our"). If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Description of Service

fShare is a free, browser-based peer-to-peer file transfer service. It enables users to send files directly from one browser to another using WebRTC technology, without storing file content on our servers. The Service includes:

• User account creation and authentication
• Generation of one-time 6-digit beam codes for file transfers
• WebRTC-based peer-to-peer data channel establishment
• Transfer history and account management

The Service is provided free of charge. We reserve the right to add optional paid features in the future, but the core P2P transfer functionality will remain free.

3. Accounts & Registration

To send files using fShare, you must register for a free account. Recipients do not need an account to receive files.

• You must be at least 13 years old (16 in the EU) to create an account.
• You are responsible for maintaining the confidentiality of your login credentials.
• You are responsible for all activity that occurs under your account.
• You must provide accurate information during registration.
• You may not create accounts on behalf of others without their authorization.
• You may not share your account credentials with others.

4. Acceptable Use Policy

You agree to use fShare only for lawful purposes and in accordance with these Terms. You agree to:

• Comply with all applicable local, national, and international laws and regulations
• Respect the intellectual property rights of others
• Obtain proper consent before transferring files that contain personal information about other people
• Use the Service for legitimate personal, educational, or business file transfer needs

5. Prohibited Content & Activities

You may not use fShare to transmit, share, or facilitate:

• Child sexual abuse material (CSAM) or any content that sexually exploits minors
• Content that violates any applicable law or regulation
• Copyrighted material without authorization from the rights holder
• Malware, ransomware, viruses, trojans, or any malicious software
• Content that constitutes harassment, threats, or abuse of any individual
• Classified government information, trade secrets, or confidential data you are not authorized to share
• Content designed to facilitate terrorism, violence, or hate crimes

You also may not:

• Attempt to circumvent or reverse-engineer the Service's technical infrastructure
• Use automated bots, scrapers, or scripts to access the Service
• Attempt to gain unauthorized access to our systems, servers, or other users' accounts
• Use the Service in a manner that could damage, disable, or impair its operation
• Impersonate Aquila Innovations, our employees, or any other person or entity
• Create multiple accounts to circumvent account suspensions

Because fShare is peer-to-peer and we do not store or inspect file content, we technically cannot monitor transfers. However, we reserve the right to act on reports of abuse, suspend accounts, and cooperate with law enforcement investigations as required by law.

6. Intellectual Property

Our Content

The fShare service, including its design, code, logos, user interface, and documentation, is the intellectual property of Aquila Innovations and is protected by applicable copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.

Your Content

Because fShare does not store your files, we make no claim of ownership over any files you transfer. You retain all rights to the content you send and receive using the Service. By using fShare, you represent that you have the legal right to transfer the files you send.

7. Privacy

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using fShare, you consent to the practices described in our Privacy Policy.

8. Disclaimers & Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, AQUILA INNOVATIONS DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

• Implied warranties of merchantability and fitness for a particular purpose
• Warranties that the Service will be uninterrupted, error-free, or secure
• Warranties regarding the accuracy or completeness of any information provided
• Warranties that defects will be corrected

We do not warrant that the Service is free of viruses or other harmful components. WebRTC connections depend on your network and device conditions, which are beyond our control.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AQUILA INNOVATIONS AND ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, AND SUPPLIERS SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, use, goodwill, or other intangible losses
• Damages resulting from your access to or use of (or inability to access or use) the Service
• Any conduct or content of third parties using the Service
• Unauthorized access to or alteration of your transmissions or data
• Failed or interrupted file transfers due to network conditions

Our total liability to you for any claim arising from these Terms or the Service shall not exceed INR 1,000 (or your local equivalent), regardless of the form of action.

10. Indemnification

You agree to defend, indemnify, and hold harmless Aquila Innovations and its officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

• Your violation of these Terms
• Your violation of any third-party rights, including intellectual property rights
• Any content you transmit using the Service
• Your use of the Service in violation of applicable law

11. Termination

We reserve the right to suspend or terminate your account and access to the Service at any time, with or without notice, for any reason including but not limited to violation of these Terms.

You may terminate your account at any time by contacting us. Upon termination, your account data will be deleted in accordance with our Privacy Policy.

Sections 5, 6, 8, 9, 10, and 12 shall survive termination of these Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in India.

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

13. Changes to Terms

We may modify these Terms at any time. We will provide notice of material changes by updating the "Last updated" date and, where appropriate, by notifying you via email. Your continued use of the Service after changes become effective constitutes acceptance of the updated Terms.
